Please read this agreement carefully. By downloading music  from this web site, you the licensee, are agreeing to the terms and conditions that appear below. This site is owned and operated by David Ellis.

When you Download songs from this site  copyright is paid through MCPS PRS.  Using this site will support the music makers and protect producers.  You must not copy, give away, swap or sell or broadcast any of your Downloaded tracks.  Doing so would be an infringement of Copyright and punishable by law.  Your license does grant you the right to use your baking tracks for your own performances.  If you have concerns about your rights or if you know anyone who is breaching copyright please drop us a line.

The Audio content on this site with backing vocals are not performed, sung or endorsed by the original artists, the music has been recorded and produced in the style of the artist, in order to represent that version as closely as possible.

The Licensee may not:

Alter the fundamental character of the songs, re-title, add or change lyrics without the express written permission of the copyright owner.

Resell, license, lease or in any way distribute songs or content from this web site to any third party without the express written permission of the copyright owner.
 

Any performance of the songs on television or other performance venues under the jurisdiction of a performance rights agency (PRS, ASCAP, BMI etc.) may incur fees independent of this Agreement to use the material for free. Please consult with the relevant performance rights organisations regarding this if you are planning to release a song in this manner. Normally, the broadcasting network and not you pay these fees.

Intellectual Property

All copyright, database right and other intellectual property rights in the material on this site (the "Content") belong to "Funky Tiger Backing Tracks" or its licensors.

Governing law

These Terms shall be governed by, and construed in accordance with, English law. The parties irrevocably agree that the courts of England shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute that may arise out of, under, or in connection with these Terms or the relationship established by them.

"Funky Tiger Backing Tracks" shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or, where these Terms are entered into in the course of your trade or profession, the country of your principal place of business.

Use in public events
Funky Tiger Backing Tracks are happy to allow the use of our soundtracks in public places and during events, commercial or not.
However, and for your information, we'd like to remind you that you must receive an official agreement from your national music rights management office (MCPS in UK for example) to be legally compliant.
If the event is private and non-commercial, use of soundtracks is, of course, allowed and not restricted.

IN THE EVENT OF ANY MATERIAL BREACH OF THIS AGREEMENT OR ANY USE OF THE SONGS BY A THIRD PARTY, ALL RIGHTS GRANTED UNDER THIS AGREEMENT SHALL TERMINATE IMMEDIATELY. CONTINUED USE OF THE SONGS BY THE LICENSEE SHALL CONSTITUTE AN INTENTIONAL INFRINGEMENT OF THE COPYRIGHTS IN AND TO THE MUSIC. THE COPYRIGHT OWNER(S) OF THE MUSIC HEREBY RESERVES ALL THEIR RIGHTS TO LEGAL AND FINANCIAL REMEDIES AND RELIEF.
